| Terms and Conditions of Business |
The following terms and conditions apply to all land sold by Strategic UK land Ltd.
1. Plots sold by Strategic UK Land Ltd are not designated for development and do not have any planning permission. Whilst care is taken in selecting investment sites, future re-zoning and / or planning permissions and future price performance are not guaranteed. The value of land may rise as well as fall.
2. All land sold is freehold land. Upon completion, Strategic UK Land Ltd transfers the land with vacant possession and from then on has no involvement with the land or in a pursuing planning permission.
3. Recent copies of Land Registry title of ownership and Charges Register/Covenants as well as other Searches are available upon request by a client or his/her solicitor.
4. Strategic UK Land Ltd accepts the purchase price (further - the "Price") for the Plot(s) being paid in two stages. The first payment is equal to 10% of the Price and is to be paid on the signing of the Land Order Form overleaf. The second payment (being the difference between the Price and the first payment) to be paid not more than 30 days after the signing of the Land Order Form overleaf. The first payment shall be treated as a reservation fee and ensures that a relevant plot/s is/are removed from the market. In the event that the second payment is not received within the 30 day period, the reservation fee shall become non-refundable and Strategic UK Land Ltd reserves the right to re-market the Plot(s) to other prospective purchasers.
5. The Buyer shall be deemed to purchase the Plot(s) with full notice and knowledge of all matters contained, mentioned or referred to in the Title Documents (whether inspected or not) and shall not raise any requisition or make any objection in relation to them.
6. By signing the Land Order Form, the Buyer(s) confirm that they have read and accept the conditions detailed herein and that the purchase of the Plot(s) by the Buyer is based solely upon the Buyer's own inspection of the Land, the Plot(s) and the Title Documents and is not in reliance upon any representation or warranty either written or oral or implied made by or on behalf of Strategic UK Land Ltd (except any representation or warranty contained in written replies given by the solicitors of Strategic UK Land Ltd to any preliminary enquiries raised by the Buyer or the Buyer's solicitors).
7. All maps, layouts and images are for illustration purposes only. Strategic UK Land Ltd does not accept responsibility for any errors or omissions and they do not constitute an offer or contract.
8. Individual plot sizes are approximate and are offered in good faith but Strategic UK Land Ltd cannot guarantee total accuracy. Purchasers should verify any detail of importance prior to viewing and purchase.
9. Strategic UK Land Ltd is not regulated by the FSA and therefore is not qualified to give financial advice. Furthermore, it insists that all prospective clients take independent legal advice during purchase (if you need specific advice, you should consult a suitably qualified professional).
10. The buyer/buyers hereby covenants with the seller/sellers by way of indemnity only that he/she/they will at all times duly perform and observe the covenants, conditions and agreements contained in the Charges Register, if any, and keep the seller/sellers and his estate and effects indemnified against all actions, proceedings, costs, claims and demands whatsoever arising in respect of any future breach thereof.
11. After the payment has been processed, there is no cancellation period and no refund of any money paid for any reason.
